Regulatory Amendments and Deposit Limits
The DGOJ has opened a public consultation regarding specific amendments to the Remote Gambling Act. Proposed updates include stricter player identification procedures to reduce income tax evasion, a mandatory registry for approved B2B software providers to combat unlicensed gambling, and expanded advertising restrictions. Implementing these measures requires new primary legislation. The Spanish government simultaneously approved a regulatory framework for cross-operator deposit limits, with a six-month testing phase beginning on September 25 and full implementation scheduled for March 25, 2027. H2 Gambling Capital estimates the limits will reduce annual onshore player spending by €300m, while market channelization is projected to fall from 76% to 74% in 2027 before stabilizing near 71% from 2028 onward.Prediction Market Integration
Regulatory discussions also addressed prediction markets following recent DGOJ enforcement actions against Polymarket and Kalshi. ECIJA legal representatives noted that existing Spanish rules permit player-versus-player wagering on sporting events, with operators functioning solely as intermediaries. This structure suggests prediction markets focused on sports or horse racing could operate within the current licensing framework.
